DRAFT — These terms are pending legal review and sign-off.
1. Agreement to Terms
These Customer Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and SEQURE PTY LTD (ABN pending), trading as Sequre Information Management (“Sequre”, “we”, “our”, or “us”).
By creating an account, accessing our websites (seq.im and related subdomains), or using any of our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.
These Terms should be read in conjunction with our Privacy Policy, which explains how we collect, use, and protect your personal information.
2. Description of Services
Sequre provides the following services:
2.1 Authentication Services
Secure authentication infrastructure that allows you to log in to participating services using a single account. Authentication may use passkeys (WebAuthn), biometric verification on your device, or federated sign-in via third-party providers (such as Google or Apple).
2.2 Identity Verification Services
Identity verification (Know Your Customer, or KYC) services that allow you to prove your identity to participating services. Verification may be performed via ConnectID (federated through participating Australian banks) or through a third-party identity verification provider. The specific verification requirements depend on the service you are accessing and applicable regulatory obligations.
2.3 Future Services
We may introduce additional services (including payment infrastructure) in the future. Any new services will be subject to these Terms or to additional terms that will be presented to you at the time of launch.
3. Account Registration
3.1 Eligibility
You must be at least 10 years of age to create a Sequre account. If you are under 16 years of age, your account must be created with the consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of our services.
3.2 Account Information
You agree to provide accurate, current, and complete information when creating your account and to update your information as necessary to keep it accurate.
3.3 Account Security
You are responsible for maintaining the security of your account, including the devices you use for authentication. You agree to notify us immediately if you become aware of any unauthorised use of your account.
We are not liable for any loss or damage arising from your failure to maintain the security of your account or devices.
3.4 Account Limits
Each individual may hold a maximum of two Sequre accounts (for example, one personal and one business account). Each account must be registered with a unique phone number. Creating accounts beyond this limit may result in suspension or termination of the excess accounts.
4. Identity Verification
4.1 Accuracy of Information
When submitting identity documents or information for verification, you represent and warrant that all information is accurate, genuine, and relates to you personally. Submitting false, misleading, or fraudulent identity information is a serious breach of these Terms and may constitute a criminal offence.
4.2 Third-Party Processing
Where identity verification is performed via a third-party provider, your identity documents and information are transmitted to that provider for processing. By submitting your information for verification, you consent to this transmission. Our Privacy Policy provides further detail on how your information is handled.
4.3 Verification Outcomes
We do not guarantee that identity verification will be successful. Verification outcomes depend on the information you provide, the requirements of the third-party provider, and the verification level required by the service you are accessing. If verification is unsuccessful, you may be unable to access certain services.
4.4 Document Integrity
We maintain cryptographic records related to identity documents submitted for verification. These records are used for the ongoing integrity and security of our verification services. By submitting documents for verification, you acknowledge that these records will be retained as described in our Privacy Policy.
5. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose or in violation of any applicable law or regulation
- Submit false, misleading, or fraudulent information, including identity documents that do not belong to you
- Attempt to create multiple accounts or circumvent account restrictions
- Interfere with, disrupt, or attempt to gain unauthorised access to our services, servers, or networks
- Reverse engineer, decompile, or disassemble any part of our services, except as permitted by law
- Use unauthorised automated systems (such as scrapers or credential-stuffing tools) to access our services. This does not restrict the use of software agents that are authenticated through your Sequre account and operating within the permissions you have granted them
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity. Software agents acting on your behalf must be clearly identified as agents and must operate within the scoped permissions you have assigned
- Use our services in any way that could damage our reputation or the reputation of our partners and integrated services
6. Intellectual Property
6.1 Our Property
All content, features, functionality, software, designs, trademarks, and other intellectual property associated with our services are owned by or licensed to SEQURE PTY LTD and are protected by Australian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of our services without our prior written consent.
6.2 Your Content
You retain ownership of any personal information and identity documents you submit to our services. By submitting this information, you grant us a limited licence to process it solely for the purposes described in these Terms and our Privacy Policy.
7. Suspension and Termination
7.1 Termination by You
You may terminate your account at any time by contacting us. Upon termination, your personal information will be handled in accordance with our Privacy Policy, including the deletion of personal information and the retention of non-personal records (such as cryptographic document fingerprints) as described therein.
7.2 Suspension or Termination by Us
We may suspend or terminate your account, without prior notice, if we reasonably believe that:
- You have breached these Terms
- Your account is being used for fraudulent or unlawful activity
- Continued provision of services to you would expose us to legal or regulatory risk
- We are required to do so by law, regulation, or a direction from a regulatory authority
Where practicable, we will provide you with notice and an opportunity to address the issue before suspension or termination takes effect.
7.3 Effect of Termination
Upon termination of your account, your right to use our services ceases immediately. Any services you accessed through your Sequre identity at third-party providers may also be affected — you should make alternative arrangements with those providers.
8. Disclaimers
8.1 Services Provided “As Is”
To the maximum extent permitted by law, our services are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from harmful components.
8.2 Identity Verification
While we take reasonable steps to ensure the accuracy of our identity verification services, we do not guarantee that verification outcomes are infallible. Identity verification is one component of a broader trust and risk framework and should not be relied upon as the sole determinant of an individual’s identity or trustworthiness.
8.3 Third-Party Services
Our services integrate with third-party providers (including identity verification providers, ConnectID, and federated sign-in providers). We are not responsible for the availability, accuracy, or conduct of third-party services.
8.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law), or any other applicable law that cannot be excluded, restricted, or modified by agreement.
9. Limitation of Liability
9.1 Exclusion of Consequential Loss
To the maximum extent permitted by law, Sequre is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of (or inability to use) our services, regardless of the cause of action.
9.2 Cap on Liability
To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or related to these Terms or your use of our services is limited to the greater of: (a) the amount you have paid to Sequre in the 12 months preceding the claim; or (b) AUD $100.
9.3 Exceptions
The limitations in this section do not apply to liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law.
10. Indemnification
10.1 Your Indemnification
You agree to indemnify and hold harmless Sequre, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms
- Your use of our services
- Any false, misleading, or fraudulent information you provide, including identity documents
- Your violation of any applicable law or regulation
10.2 Our Indemnification
Sequre agrees to indemnify and hold harmless you from and against any claims, liabilities, damages, losses, and expenses arising directly from a breach of your personal information caused by Sequre’s gross negligence — for example, a failure to implement reasonable security measures for the protection of personal information held in our systems.
11. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify you by email or through a prominent notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.
If you do not agree with the updated Terms, you may terminate your account before the effective date.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
